| Terms and Conditions for Consumers |
Thank you very much for your order with Christmas Direct. Please take a few minutes to read our terms and conditions below.
Christmas Direct Ltd is part of the Corporate Christmas Tree Company Ltd (CCTC Ltd), Milton, Amulree Dunkeld Perthshire PH8 0EB Registered VAT number 717 3702 42. The following terms and conditions will apply between you and CCTC Ltd, when you purchase an item from xmasdirect.co.uk These terms & Conditions do not affect your statutory rights.
- Our entire liability to you under these Terms and Conditions Policy shall not exceed the price paid for the goods you have purchased through Xmasdirect.co.uk provided that we take reasonable care when we deliver the goods to you.
We will not be liable to you for any loss of revenue, profits, anticipated savings, goodwill or business opportunity, for any injury to your reputation or for any losses that are not reasonably foreseeable by both of us at the time your order is accepted.
- Christmas Direct cannot accept your order until you have paid for it in full (including applicable delivery charges). Upon payment, we will confirm acceptance of your order by e-mail which will be sent to the e-mail address you provide on your order details. Whether or not you receive the e-mail, our acceptance of your order will create a legally binding contract between us. We reserve the right not to supply you at our discretion.
- Orders will only be accepted from people aged 18 or over. By placing an order you are therefore accepting these terms and conditions and you are confirming you are aged over 18
- Orders can be delivered world wide, all prices on the site are UK prices including VAT but exclusive of postage and packaging. All orders will be accepted in GBP only. If the actual delivery cost is considerably higher than the quoted amount on the site, then we will be in touch with you with an amended delivery fee.
- Most major Credit Cards are accepted as well as cheques or BACS payments. No goods will be despatched until full payment has been cleared in our bank.
- Credit card transactions of over £1000 will be subject to a 2% fee. If paid by BACS or electronic transfer there will be no surcharge.
- Please check your order carefully before submitting it, whilst we are happy to replace or exchange any faulty or damaged goods we cannot be held responsible for user errors in the ordering process.
Cancellation Of An Order
- You are entitled to cancel your order and thereby your contract with CCTC Ltd up to 7 working days after the day of delivery. If you wish to cancel the order you must inform us in writing, either by post or email. If you wish to cancel an order prior to delivery you must contact Christmas Direct Ltd on 0845 3700 333 in order to stop the order being dispatched and then confirm the conversation by email immediately. A full refund including postage will be given. If the item has been dispatched or has been delivered (for clarity, an item is deemed delivered upon leaving the delivery vehicle), it is your responsibility to return the goods to Christmas Direct Ltd at your own cost. If you require Christmas Direct Ltd to pick up the goods, any charges incurred returning the goods will be paid for by you. Please see the returns section below.
- For any orders that have been specially ordered in for you from a third party i.e. the product is not held in our stock, we cannot accept returns. We recommend you ask for samples and make your decision from those prior to your order.
Delivery
Returns Policy
- You have 7 working days from the day after the date of delivery where you can cancel the order and receive a full refund (see Refunds below). You must inform us in writing by letter or email that you wish to return the goods and cancel your order. You must then, at your expense, send the goods back to Christmas Direct Ltd, Milton, Amulree, Dunkeld, Perthshire PH8 0EB or enable Christmas Direct Ltd to pick up the goods from you, again at your expense. During the time the goods are in your possession you agree to take reasonable care of the goods. Examples of a failure to take reasonable care of goods may include if you use the goods, if you assemble or part assemble the goods or if you remove the goods from their packaging and fail to properly repack them. If your failure to take reasonable care of the goods means that they cannot be resold as new we reserve the right to apply a charge of 30% of the price you paid for the goods, which you agree we may discount from your refund for the goods.
- If the goods are damaged whilst in your care (including damage caused in assembling or disassembling the goods), if you fail to return all parts of the goods or otherwise if your failure to take reasonable care of the goods means that we reasonably believe that resale will not be possible at all, you agree that we may withhold payment of all or part of the refund in respect of the goods as compensation for our loss on these goods.
- This Returns Policy does not take away any rights you may have under consumer law. For more information contact your local Citizens Advice Bureau (www.citizensadvice.org.uk) in England and Wales and http://www.cas.org.uk/ in Scotland.
- This Returns Policy is in accordance with your right to cancel a contract formed at a distance under the Consumer Protection (Distance Selling) Regulations 2000
Refunds Policy
- When cancelling an order that has been dispatched you are entitled to a full refund including the delivery charge. However, if you select any option other than the standard delivery option, i.e. a timed delivery, a Saturday delivery or if the standard delivery for the item is post and you choose the courier option, or a specialist item eg artificial trees over 6ft, you are only entitled to be refunded for the standard delivery cost as you have effectively changed the order to become as specialist order, which increases the cost of delivery to Christmas Direct Ltd. Artificial Christmas Trees are considered a specialist order when the height exceeds 6ft. the maximum refund for delivery will be £8.50.
Faulty Goods Policy
- All products purchased from Christmas Direct are guaranteed according to Consumer law. If there is a fault with any of our goods please contact us and we will deal with the matter in accordance to your legal rights.
General
- We will not be responsible for any delay or failure to comply with these Terms of Sale or the Returns Policy if the delay or failure arises from any event which is beyond our reasonable control. Such events would include (but are not limited to) fires, floods, earthquakes, storms, natural disasters, war, civil unrest, acts of terrorism or malicious damage to or destruction of our premises, equipment or goods.
- In the event that one or more of the terms set out in these Terms of Sale or in the Returns Policy is held to be invalid by a competent authority, the remaining terms shall continue to have effect and you will still be bound by them
- The Conditions shall be governed by and construed in accordance with the laws of Scotland and you irrevocably submit to the exclusive jurisdiction of the courts of Scotland
- You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person accessing the Website using your shopping account and/or your Personal Information
- The Conditions shall be governed by and construed in accordance with the laws of Scotland and you irrevocably submit to the exclusive jurisdiction of the courts of Scotland
- All products, pictures and text on this website are copyright to Christmas Direct Ltd. None of the images or text can be copied or used by any other website.
- Christmas Direct Ltd is trading under the Corporate Christmas Company Limited, (CCTC Ltd), therefore all payments by credit card will be credited to Corporate Christmas Tree Company Ltd and all invoices will be from CCTC Ltd VAT Reg No: 717 370 242.
- Christmas Direct Ltd is a trademarked name.
- These terms were last changed on 25th April 2008 and will apply to all transactions on or after that date. We may change our terms and conditions at any time, please do not assume that the same terms will apply to future orders.
