Thank you very much for your order with Christmas Direct. Please take a few minutes to read our terms and conditions below.

The following terms and conditions will apply between you and CCTC Ltd, when you purchase an item from xmasdirect.co.uk These terms & Conditions do not affect your statutory rights.

Our entire liability to you under these Terms and Conditions Policy shall not exceed the price paid for the goods you have purchased through Xmasdirect.co.uk provided that we take reasonable care when we deliver the goods to you.
We will not be liable to you for any loss of revenue, profits, anticipated savings, goodwill or business opportunity, for any injury to your reputation or for any losses that are not reasonably foreseeable by both of us at the time your order is accepted.
Christmas Direct cannot accept your order until you have paid for it in full (including applicable delivery charges). Upon payment, we will confirm acceptance of your order by e-mail which will be sent to the e-mail address you provide on your order details. Whether or not you receive the e-mail, our acceptance of your order will create a legally binding contract between us. We reserve the right not to supply you at our discretion.
Orders will only be accepted from people aged 18 or over. By placing an order you are therefore accepting these terms and conditions and you are confirming you are aged over 18
Orders can be delivered world wide, all prices on the site are UK prices including VAT but exclusive of postage and packaging. All orders will be accepted in GBP only. If the actual delivery cost is considerably higher than the quoted amount on the site, then we will be in touch with you with an amended delivery fee.
Most major Credit Cards are accepted as well as cheques or BACS payments. No goods will be despatched until full payment has been cleared in our bank.
Credit card transactions of over £1000 will be subject to a 2% fee. If paid by BACS or electronic transfer there will be no surcharge.
Please check your order carefully before submitting it, whilst we are happy to replace or exchange any faulty or damaged goods we cannot be held responsible for user errors in the ordering process.

Cancellation Of An Order

You are entitled to cancel your order and thereby your contract with CCTC Ltd up to 7 working days after the day of delivery. If you wish to cancel the order you must inform us in writing, either by post or email. If you wish to cancel an order prior to delivery you must contact Christmas Direct Ltd on 0845 3700 333 in order to stop the order being dispatched and then confirm the conversation by email immediately. A full refund including postage will be given.  If the item has been dispatched or has been delivered (for clarity, an item is deemed delivered upon leaving the delivery vehicle), it is your responsibility to return the goods to Christmas Direct Ltd at your own cost. Please see the returns section below.
For any orders that have been specially ordered in for you from a third party i.e. the product is not held in our stock, we cannot accept returns. We recommend you ask for samples and make your decision from those prior to your order.

Delivery

Standard Delivery Charges: Under 1000g: Post £3.50- £5.50 1000-5000g: Courier £5.99 5kg-15kg: £9.99 Any item over 15kg is a specialised delivery charge.
All prices quoted are for the UK Mainland and are considered standard delivery options for that area, please see below for areas not included in the standard delivery options**. - We have had many years of courier experience and now we have found a courier company who we consider to be excellent. At Christmas time couriers become more and more unreliable therefore we have opted for customer satisfaction and Initial City Link has proved to be superb. We have great confidence in this company to deliver your orders up to the 22nd December!  We cannot be beaten for next day delivery at £5.99 *For 'standard' size packages - greater charges will be incurred for bigger / heavier packages. Remember that large artificial Xmas trees come in very big heavy boxes. You will see a full range of delivery options / prices at the shopping cart page. Our delivery costs are always very competitive!
Next Day Delivery means next Working Day. Saturday deliveries incur a surcharge. For the Highlands & Scottish Islands there may be restricted delivery options, including no timed delivery and no guarantee of next working day.
**Only specialised delivery options are available for the Scottish Islands, Isle of Man, Northern Ireland and Channel Islands - if the shopping basket selects Courier that is considered a specialist order even if no other option is available. When you place an order you will have a unique City Link tracking number which can be emailed to you separately. Citylink tracking number will start with the letters GO. You will be able to track your order http://www.city-link.co.uk/track_parcel/track_parcel.php Enter your order number (beginning with XS) in the "Customer reference" box.  If that fails you can email us delivery@xmasdirect.co.uk and we will let you know how your delivery is progressing.
With Initial City Link, for surcharge, we can deliver an item to you at a specific time on a specific day although you will have to contact us at delivery@xmasdirect.co.uk to arrange this. Our options available to you are as follows:
Before Noon
Before 1030
Before 0900
 

Refunds may be claimed  for delivery surcharges if a timed delivery (e.g. pre-noon) is missed.

For 1st Class post delivery, the delivery date on the confirmation is an ESTIMATE only; we cannot track Royal Mail deliveries. Bear in mind that the 1st class post can take over a week to arrive close to Christmas. If you want tracked delivery, choose the courier option!
Orders under 1000g in weight If your order is under 1000g in weight it will be despatched by 1st Class post, the cost here would be £3.50-£5.50.You can select next day delivery by courier if you wish, this will increase your order delivery cost to £5.99 automatically.
Orders over 1000g in weight The majority of orders above 1000g will be automatically sent out on a next day delivery in a Citypack bag (300mm by 400mm) up to 5Kg the charge will be £5.99 if you place your order before the 1300 cut off time. You can select fast track if you order between 1300 and 1400 your order will go to the top of the queue and be rushed to catch that afternoon’s courier – this service is charged at £5.50.
If you do not want your order to be delivered next day then you can select a date for it to be delivered to you. This will not reduce the cost as we will still send it out on a next day service the day before you require your order. If you order is over 5Kg in weight or cannot fit into a Citypack your delivery will increase to £9.99 as standard for next day delivery in the UK. Artificial Christmas trees are charged by weight – some are extremely heavily. You can place an order in the shopping basket to view the delivery prices without having to proceed with the order.
If you are not in........Please choose a delivery date when you know you will be in or we can deliver to your place of work. Citylink deliver anytime between 9am – 8pm. If you are not in then our drivers can leave your order somewhere safe only if you leave instructions on your order, we cannot guarantee this service as some drivers will not leave any items without a signature and also we will not take responsibility for any losses if you choose this option.
We strongly encourage you to give us an alternative delivery option which can include leaving with an immediate neighbour or within the bounds of your address. However if these options fail your package will be taken back to Citylink’s warehouse. Once this happens it is your responsibility to inform Christmas Direct and Citylink. You should have a yellow card put through your letterbox. Whether you receive a card or not - You must contact either your local branch from the details on this card or telephone Citylink on 08700 007007 and arrange a convenient delivery date – Failure to do so might incur further delivery charges.
Packages that were unable to be delivered and where no contact has been made by you, will be returned to Christmas Direct Ltd and you will be charged for the return to us. If you require the package to be re-sent you will be charged again for the delivery, so please make every effort to contact us. If you have an unusual address or numbering of the buildings or you know the address to be hard to find, please include these details on your order or email us separately with the details immediately after placing the order, so we can contact Citylink to ensure the best possible chance of your parcel being delivered on time.
We are unable to issue refunds for late delivery by courier or post when Christmas Direct has fulfilled its obligation in despatching on time.

Returns Policy

You have 7 working days from the day after the date of delivery where you can cancel the order and receive a full refund (see Refunds below). You must inform us in writing by letter or email that you wish to return the goods and cancel your order. You must then, at your expense, send the goods back to Christmas Direct Ltd, Milton, Amulree, Dunkeld, Perthshire PH8 0EB. During the time the goods are in your possession you agree to take reasonable care of the goods. Examples of a failure to take reasonable care of goods may include if you use the goods, if you assemble or part assemble the goods or if you remove the goods from their packaging and fail to properly repack them.
Returns outside 7 working days will only be accepted with prior permission and will be subject to a 20% restocking fee.
If you fail to take reasonable care of the goods - If the goods are damaged whilst in your care (including damage caused in assembling or disassembling the goods) or If you fail to return all parts of the goods or otherwise, we may take action against you for breach of the statutory duty which requires you to take reasonable care of the goods in your possession.
This Returns Policy does not take away any rights you may have under consumer law. For more information contact your local Citizens Advice Bureau (www.citizensadvice.org.uk) in England and Wales and http://www.cas.org.uk/ in Scotland.
This Returns Policy is in accordance with your right to cancel a contract formed at a distance under the Consumer Protection (Distance Selling) Regulations 2000

Refunds Policy

When cancelling an order that has been dispatched you are entitled to a full refund including the delivery charge. However, if you select any option other than the standard delivery option, i.e. a timed delivery, a Saturday delivery or if the standard delivery for the item is post and you choose the courier option, or a specialist item eg artificial trees over 6ft, you are only entitled to be refunded for the standard delivery cost as you have effectively changed the order to become a specialist order, which increases the cost of delivery to Christmas Direct Ltd. Artificial Christmas Trees are considered a specialist order when the height exceeds 6ft. the maximum refund for delivery will be £8.50.
Christmas Direct will not refund the delivery charge for orders that are delivered later than specified on your order confirmation as this will be the fault of our couriers or the Royal Mail. However, if your goods do not arrive at all then obvioulsy a full refund will apply.

Faulty Goods Policy        

All products purchased from Christmas Direct are guaranteed according to Consumer law. If there is a fault with any of our goods please contact us and we will deal with the matter in accordance to your legal rights. Products are covered by guarantee in their original state as sold.

General

We will not be responsible for any delay or failure to comply with these Terms of Sale or the Returns Policy if the delay or failure arises from any event which is beyond our reasonable control. Such events would include (but are not limited to) fires, floods, earthquakes, storms, natural disasters, war, civil unrest, acts of terrorism or malicious damage to or destruction of our premises, equipment or goods.
In the event that one or more of the terms set out in these Terms of Sale or in the Returns Policy is held to be invalid by a competent authority, the remaining terms shall continue to have effect and you will still be bound by them
You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person accessing the Website using your shopping account and/or your personal information.
All products, pictures and text on this website are copyright to Christmas Direct Ltd. None of the images or text can be copied or used by any other website.
Christmas Direct Ltd is trading under the Corporate Christmas Company Limited, (CCTC Ltd), therefore all payments by credit card will be credited to Corporate Christmas Tree Company Ltd and all invoices will be from CCTC Ltd VAT Reg No: 717 370 242.

These terms were last changed on 25th April 2008 and will apply to all transactions on or after that date. We may change our terms and conditions at any time, please do not assume that the same terms will apply to future orders.
